By using Laritor(Dudi Labs LLP), you agree to these Terms of Service.
1. Definitions
Service: The Laritor web-based application and its related components.
User: Any individual or entity that accesses or uses the Service.
Subscription: A recurring plan that allows access to paid features of Laritor.
2. Use of Service
You agree to use Laritor in accordance with all applicable laws and regulations. By using our service, you further agree to the following:
- Permitted Usage: You may use Laritor solely for monitoring and optimizing the performance of your web applications. You must have proper authorization to monitor the systems and data you connect to Laritor.
- Prohibited Content: You may not use Laritor to monitor or process applications that:
- Contain or promote adult content, gambling, or illegal activities.
- Infringe on intellectual property rights.
- Violate data protection or privacy laws.
- Abuse Prevention: You may not attempt to disrupt, degrade, or bypass Laritor's monitoring infrastructure or abuse the system (e.g., by generating artificial traffic, excessive requests, or using the platform for benchmarking without permission).
- Security Compliance: You must ensure your usage of Laritor does not introduce security vulnerabilities or malicious scripts. You are responsible for securing API keys and access tokens.
- Automated Monitoring: Laritor collects performance metrics, logs, and error reports for your connected Laravel applications. You acknowledge and accept automated collection and analysis of this data for performance insights and alerting.
- Data Ownership: You retain ownership of your data. However, by transmitting data to Laritor, you grant us the right to process it solely for the purpose of providing and improving the service.
- Third-Party Integrations: Laritor offers integrations (e.g., Slack) at your discretion. You are solely responsible for any data shared with third parties through such integrations.
3. User Accounts & Security
To access Laritor's services, you must create an account and provide accurate, complete, and current information during the registration process. By creating an account, you agree to the following:
- Account Responsibility: You are solely responsible for maintaining the confidentiality of your login credentials. Any activity under your account is deemed to be your responsibility. If you believe your account has been compromised, you must notify us immediately at [email protected].
- Account Security: We strongly encourage enabling Multi-Factor Authentication (MFA) to secure your account. Laritor is not responsible for any loss or damage arising from unauthorized use of your account due to inadequate credential management.
- Authorized Use: You must ensure that only authorized personnel within your organization access the account. You may not share your credentials with unauthorized users or allow unapproved access to the platform.
- Account Limitations: Laritor accounts may be subject to limitations on usage based on your plan (e.g., number of projects, data retention, alert frequency). You agree not to circumvent or attempt to bypass these limits.
- Account Suspension: We reserve the right to suspend or terminate your account if we detect suspicious activity, a security risk, or a breach of these Terms.
4. Subscription, Free Trial & Refunds
Subscriptions are billed through Paddle.com, our authorized reseller and Merchant of Record. Users can manage, upgrade, or cancel their subscriptions via their Laritor account dashboard or through Paddle’s subscription management portal. If a subscription is canceled, users must stop sending data to Laritor within 5 days. Overage usage incurred before cancellation will be billed on the final invoice.
- Free Trial: Laritor offers a 15-day free trial for new users, allowing access to core features without charge. At the end of the trial period, you will be prompted to choose a subscription plan to continue using the service. No credit card is required to start the trial.
- Subscription Plans: Laritor provides multiple subscription tiers. Each plan includes a base monthly or annual fee and may have usage limits based on data volume processed and the number of hits received. Exceeding these limits will result in overage charges.
- Overage Charges: If your usage exceeds the limits defined in your subscription plan, you will be billed for the additional usage based on our current pricing model. These overages may be calculated monthly and billed in arrears.
- Billing: Subscriptions are automatically renewed at the end of each billing cycle unless canceled prior to the renewal date. All charges are billed in U.S. dollars (USD) and will appear on your invoice or payment receipt.
- Refunds: Refunds are assessed on a case-by-case basis. Eligible cases may include billing errors, service disruptions, or other justified reasons. In some cases, instead of a refund, Laritor may issue Laritor credits, which can be applied toward future subscription or overage charges.
Refund requests must be submitted within 30 days of the charge via [email protected]. If a refund is granted, it may be processed either as a direct refund to the original payment method or issued as a Laritor credit for future billing periods.
We do not offer prorated refunds for partial months of service or unused features. - Billing Disputes: If you believe you’ve been billed in error, please contact us at [email protected] within 15 days of the invoice date. Disputes raised after this period may not be eligible for adjustment or review.
5. Cancellation
- User-Initiated Cancellation: You may cancel your subscription at any time through your Laritor account dashboard. Upon cancellation, your account will remain active until the end of the current billing cycle, after which it will be downgraded to a free tier or deactivated, depending on your account status.
- Data Submission Post-Cancellation: You must cease sending performance data to Laritor within 5 days of cancellation. Continued data transmissions beyond this period may be blocked or discarded without notice.
- Account Data: We retain your monitoring data and account configuration for up to 30 days after cancellation, allowing you to export or retrieve data if needed. After this period, your data may be permanently deleted, unless required for legal or regulatory reasons.
- No Partial Refunds: Cancellations do not entitle you to refunds for unused time within your current subscription term. However, if your cancellation is due to service-related issues, you may contact our support team to request a review.
- Reactivation: You may reactivate your account at any time by selecting a plan and resuming payment. Prior data may not be recoverable after the retention period.
6. Service Availability
- Uptime Commitment: Laritor strives to maintain high availability and performance of the service. However, we do not guarantee uninterrupted or error-free operation, except where explicitly covered under a Service Level Agreement (SLA) available to enterprise customers.
- Planned Maintenance: We may occasionally perform scheduled maintenance, which may result in temporary unavailability of the service. When possible, we will provide advance notice via email or dashboard alerts.
- Emergency Maintenance: In the event of unexpected issues that require immediate attention, Laritor may perform emergency maintenance without prior notice to ensure the integrity and security of the platform.
- Third-Party Services: Laritor may rely on third-party cloud providers and infrastructure vendors. Downtime or disruptions in these services may impact Laritor’s availability, for which we are not directly responsible.
- Support and Monitoring: Our systems are monitored 24/7 for critical issues. Support for availability-related incidents is provided during business hours for all users, and 24/7 for enterprise customers with active support agreements.
7. Limitation of Liability
- No Indirect Damages: To the fullest extent permitted by law, Laritor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, whether incurred directly or indirectly, arising from your use of or inability to use the service.
- Maximum Liability: In no event shall Laritor’s total cumulative liability for any claims arising out of or related to these Terms or the use of the service exceed the amount paid by you to Laritor in the twelve (12) months preceding the event that gave rise to the claim.
- Assumption of Risk: You acknowledge and agree that your access and use of the service is at your own discretion and risk. You are solely responsible for evaluating the accuracy, completeness, and usefulness of any data, reports, or alerts provided by Laritor.
- No Warranties: The service is provided on an “as-is” and “as-available” basis. Laritor expressly disclaims all warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
8. Intellectual Property
Laritor and its related logos, codebase, and branding are the exclusive intellectual property of the company registered in Telangana, India. All rights not explicitly granted to you under these Terms are reserved.
You retain all rights to your own data, application content, and metrics submitted through the platform.
9. Feedback and Suggestions
By submitting ideas, feature requests, or suggestions to Laritor, you agree that we may use, implement, and commercialize your feedback without compensation or obligation to you. You represent that any feedback provided is non-confidential and legally yours to share.
10. Termination
- By Laritor: We reserve the right to suspend or terminate your access to the service at any time, with or without notice, if:
- You breach these Terms of Service or violate our Acceptable Use Policy.
- Your use of the service poses a risk to the security, stability, or integrity of our systems.
- Required by law, regulatory authorities, or court order.
- By the User: You may terminate your account at any time through your dashboard or by contacting our support team. Upon termination, you remain responsible for any outstanding fees incurred prior to the termination date, including overage charges.
- Effect of Termination:
- Your access to the service will be revoked.
- Data associated with your account may be retained for up to 30 days to allow for export or recovery, after which it will be permanently deleted unless otherwise required by law.
- No Liability for Termination: Laritor shall not be liable to you or any third party for termination of your account or access to the service in accordance with these Terms.
11. Dispute Resolution
- Informal Resolution First: In the event of any dispute, claim, or controversy arising out of or relating to these Terms, the parties agree to first attempt to resolve the issue through informal negotiations. Please contact us at [email protected] to initiate the process.
- Binding Arbitration: If the dispute cannot be resolved informally within 30 days, it shall be finally resolved by binding arbitration conducted in English. The arbitration shall be administered by the American Arbitration Association (AAA) or a comparable body under its commercial arbitration rules. Each party will bear its own costs unless the arbitrator rules otherwise.
- Location and Jurisdiction: The arbitration may be conducted remotely or in a mutually agreed jurisdiction. If no agreement is reached, the location will default to a neutral international venue.
- Exception – Injunctive Relief: Either party may seek injunctive or equitable relief in a court of competent jurisdiction for any breach or threatened breach of confidentiality or intellectual property rights.
- Class Actions Waiver: To the maximum extent permitted by law, all disputes must be brought in the parties individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
12. Force Majeure
Laritor shall not be held liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet outages, service provider failures, or changes in applicable laws or regulations.
13. Changes to Terms
- Right to Modify: Laritor reserves the right to modify, update, or replace these Terms of Service at any time to reflect changes in our business practices, legal requirements, or service offerings.
- Notification of Changes: We will provide reasonable advance notice of material changes through one or more of the following methods:
- Posting an updated version on our website
- Emailing you at the address associated with your account
- In-app notifications
- Continued Use as Acceptance: Your continued use of the service after the effective date of any updated Terms constitutes your acceptance of the revised agreement. If you do not agree with the updated Terms, you must discontinue your use of the service before they take effect.
- Effective Date: The most current version of the Terms will always be available on our website and will indicate the effective date at the top of the document.
14. Governing Law
These Terms of Service and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of India, specifically under the jurisdiction of the courts located in Telangana.
Laritor also operates internationally and complies with data protection regulations applicable to its users, including but not limited to:
- General Data Protection Regulation (GDPR) – European Union
- California Consumer Privacy Act (CCPA) – United States
- UK Data Protection Act – United Kingdom
- Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 – India
Subject to the Dispute Resolution clause above, any legal proceedings that are not subject to arbitration shall be brought exclusively in the courts of Telangana, India, unless otherwise required by applicable law.
